These Terms & Conditions govern your use of danielarendzen.com and any purchase made through it from Daniel Arendzen Art&Prints (SSM: 202603180356 / CA0424123-K) (“we”, “us”, “our”), a business registered in Malaysia. By browsing the site or placing an order, you agree to these terms. Please read them alongside our Privacy Policy and Refund & Returns Policy, both linked in the site footer.
1. Who we are
Daniel Arendzen Art&Prints (SSM: 202603180356 / CA0424123-K)
Address: Batu Gajah, Perak, Malaysia
Email: reachme@danielarendzen.com
2. The work we sell
We sell two kinds of art through this site:
- Hand-pulled monotype prints — unique originals. Each is made through a gel plate printmaking process and pulled once. No two are the same, and no reproductions are made from them.
- Limited edition fine art prints, where offered — produced in a stated, finite edition size that will not be exceeded once announced.
Every piece is made by hand, from a digitally modelled and researched architectural subject through to a physically printed and signed work. Generative AI is not used at any stage of the creative process.
Because each piece is handmade, minor variation from photographs — in colour, texture, or exact mark placement — is normal and expected, and is not a defect. We try to represent colour and texture as accurately as photography and screens allow.
3. Orders and the contract of sale
Placing an order through the site is an offer to buy, which we accept when we confirm and process your order. A contract of sale is formed at that point, on these terms. We reserve the right to decline or cancel an order — for example, if a piece was mistakenly listed as available when it had already sold — in which case we will notify you and refund any payment made in full.
Prices are shown in the currency displayed at checkout and do not include customs duties, import taxes, or handling fees for international orders, which are the buyer’s responsibility (see our Refund & Returns Policy for shipping detail).
4. Pricing and availability
We make reasonable efforts to keep prices and availability on the site accurate and up to date. Because each piece is one of a kind, availability can change quickly. If an error is discovered — a pricing mistake, or a piece shown as available after it has sold — we will contact you before proceeding, and you may cancel with a full refund if you no longer wish to proceed.
5. Payment
Payment is processed securely through our third-party payment gateway at checkout. We do not store your full payment card details. All prices must be paid in full before an order is shipped.
6. Shipping
Orders ship from Malaysia, currently via DHL, generally within two working days of order confirmation. Delivery within Malaysia is complimentary; international shipping costs are calculated at checkout. International orders are shipped Delivered Duty Unpaid (DDU) — the buyer is responsible for any customs duties, import taxes, or fees charged on arrival. Full shipping detail is set out in our Refund & Returns Policy and FAQ page.
Risk in the piece — responsibility for its physical condition — passes to you on delivery. Please inspect your package on arrival and refer to our Refund & Returns Policy if it has arrived damaged.
7. Returns and refunds
Because each piece is a unique original or part of a strictly limited edition, we do not accept returns or offer refunds for change of mind. The exception is damage occurring during shipping, which is covered in full in our separate Refund & Returns Policy — please read it before ordering.
8. Accuracy of listings and buyer acknowledgment
Every piece we sell is described with specific, factual measurements and details in its product listing at the time of sale. This section sets out exactly what a buyer can rely on, and what a buyer acknowledges before completing a purchase, so that both of us — and, where relevant, a payment provider reviewing a dispute — can refer to a clear, agreed standard.
Dimensions. Every product listing states the exact dimensions of the piece, in both centimetres and inches, measured as the physical paper or panel size unless the listing states otherwise. This stated measurement is the accurate, controlling description of the piece’s size — not the impression created by a photograph. Photographs are for illustrative purposes only. Because product photographs are taken against staged backdrops, at various distances, and are viewed on screens of different sizes, a piece may appear larger or smaller in a photograph than its stated dimensions. Where a listed measurement and a buyer’s visual impression from a photograph differ, the stated measurement governs, and is not grounds for a “significantly not as described” claim. We encourage every buyer to read the stated dimensions before purchasing and to compare them, if helpful, to an object of known size in their own space.
Colour and screen variation. Colour reproduction varies between devices, screens, and browsers, and no two screens will render an image identically. We make reasonable efforts to photograph and represent each piece’s true colour accurately, but minor variation between a screen image and the physical piece is expected and is not a defect or misrepresentation.
Handmade texture and mark-making. Each piece is made entirely by hand through a printmaking or painting process. Texture, brush or brayer marks, layering, and minor surface irregularities are inherent, expected characteristics of a handmade original — not flaws. A listing photograph shows one lighting condition and one angle; the physical piece may show texture or sheen that a flat photograph cannot fully capture. This is a feature of handmade original art, disclosed here and in our Refund & Returns Policy, and is not grounds for a claim that the piece is different from its description.
What a listing description covers. A product listing’s stated title, medium, dimensions, and edition information (where applicable) are the factual description a buyer is entitled to rely on. Subjective qualities — how a piece “feels,” how large it “seems,” or a buyer’s expectation formed from viewing it on a particular screen — are not part of the item’s description and are not a basis for a claim that a piece is not as described.
Buyer acknowledgment. By completing a purchase, the buyer confirms they have read the full product listing, including its stated dimensions and medium, and accepts that photographs are illustrative and that reasonable, expected variation of the kind described in this section does not constitute a defect, error, or misrepresentation.
9. Certificates of authenticity
Where stated, a piece is accompanied by a signed Certificate of Authenticity confirming details such as title, medium, dimensions, and — for editions — edition size and pull number. The certificate is provided as documentation of the piece’s origin and is not a separate item of value independent of the artwork.
10. Intellectual property
Daniel Arendzen retains full copyright and all other intellectual property rights in every piece sold through this site, including the underlying digital models, renders, and any images used in creating a physical piece, unless a separate written licence agreement states otherwise.
Purchasing a physical piece transfers ownership of that physical object only. It does not transfer copyright, and it does not grant the buyer any right to reproduce, photograph for commercial use, create derivative works from, or otherwise commercially exploit the image of the piece without our prior written permission. Personal, non-commercial photography of a piece you own — for example, to share on social media with appropriate credit — is welcome.
All content on this site — text, photography, renders, and design — is owned by us or used with permission, and may not be copied or reused without consent.
11. Commissions
Where we agree to create a new commission inspired by a previously sold piece, the commission will be created as close to the original as our process allows, but will never be identical, since every pull is unique by nature. Specifics of a commission — subject, size, and general direction — should be agreed in writing before work begins. Once a commissioned piece is complete and shipped, it falls under the standard no-returns policy described above and in our Refund & Returns Policy.
12. Care of your piece
Works on paper are affected by humidity and direct sunlight. We recommend framing behind glass with a mat so the glass does not touch the print directly, and keeping the piece out of direct sunlight in a low-humidity space. We are not responsible for damage caused by improper display, framing, or storage after delivery.
13. Limitation of liability
To the extent permitted by Malaysian law, our liability to you in connection with any purchase is limited to the price paid for the piece in question. We are not liable for indirect or consequential loss, including loss of enjoyment, or for delays or failures caused by events outside our reasonable control, such as courier delays, customs processes, or events of force majeure.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited under Malaysian law, including liability for fraud or for death or personal injury caused by negligence.
14. Website use
You agree to use danielarendzen.com lawfully and not to misuse the site — including attempting to interfere with its operation, copying its content for commercial reuse, or using it to transmit anything harmful or unlawful. We may suspend or restrict access to the site at our discretion, including to protect its security or integrity.
We aim to keep the site accurate and available, but we do not guarantee it will be uninterrupted or error-free, and we may update, change, or take down parts of the site at any time.
15. Third-party payment providers and disputes
Payments made through this site are processed by third-party payment providers (currently PayPal and/or Stripe, as shown at checkout). These providers operate their own separate dispute and chargeback processes, governed by their own terms and by the applicable card network rules, which are independent of this agreement and outside our control.
If a buyer opens a dispute, claim, or chargeback through a payment provider rather than contacting us directly, we ask that the buyer first refer to Sections 6, 7, and 8 of these Terms and to our Refund & Returns Policy, both of which are agreed at the time of purchase and describe exactly what a buyer can expect regarding condition, accuracy of description, and returns.
We will always respond to a payment provider’s request for evidence with the buyer’s order details, the relevant product listing as it appeared at the time of sale, these Terms & Conditions, our Refund & Returns Policy, and — where relevant — proof of shipment, proof of delivery, and any pre-shipping documentation of the piece. We do this so that any review of a dispute is based on the same accurate, agreed facts available to the buyer at the time of purchase.
Nothing in this section limits a buyer’s right to pursue a dispute through their chosen payment provider, or removes any protection that provider may separately offer. It records, for clarity, what was agreed between buyer and seller under these Terms, independent of how a payment provider’s own process evaluates a claim.
16. Third-party links and services
The site may link to or rely on third-party services (such as payment processors, couriers, or social media). We are not responsible for the content, policies, or performance of those third-party services, and your use of them is subject to their own terms.
17. Changes to these terms
We may update these Terms & Conditions from time to time, for example as the business grows or our processes change. The “last updated” date at the top reflects the most recent revision. The terms in effect at the time you place an order apply to that order.
18. Governing law
These terms are governed by the laws of Malaysia. Any dispute arising from these terms or from a purchase will be subject to the exclusive jurisdiction of the courts of Malaysia, without prejudice to any mandatory consumer protections available to you under the law of your own country of residence, where applicable.
19. Contact
Questions about these terms can be sent to reachme@danielarendzen.com, or by post to Batu Gajah, Perak, Malaysia. Daniel reads and responds to enquiries personally.
